Joke or Jail?

This fella in Kentucky has put his Halloween Decorations up early, and he's took the approach of putting fake bodies of local officials in body bags, and displaying them on his front lawn. This has caught the attention of some folk and he has been arrested for it.

Now what do you think? Is this is just a joke? or a threat worthy of jail? . Now this is the US, we all know in the UK it's a deff a 10 stretch, but in the US I'm not so sure... What say you?
